These Terms are an agreement between you and MarkDid, LLC ("Pabo," "we," "us") for the Pabo language-learning app and related services. By creating an account, starting a conversation, or buying a subscription, you agree to these Terms. If you do not agree, do not use Pabo. Our Privacy Policy explains how we handle information.
1. Eligibility and accounts
You must be at least 18 years old and legally able to use the service. You must confirm that you are at least 18 before entering the app; do not confirm if you are younger. Pabo may create an anonymous guest account when you use a backend feature; you may then choose to connect an Apple or Google sign-in. Keep access to your account secure and tell us at support+pabo@markdid.dev if you believe it has been compromised. You are responsible for activity through your account except where law provides otherwise.
2. What Pabo provides
Pabo offers language practice through AI-generated spoken and typed conversations, captions, vocabulary tools, and learning progress. Availability, characters, languages, and features may change. The app may require internet access, a compatible device, and microphone permission for live voice. Some features have a free allowance; paid plans provide a stated amount of live conversation time during each subscription period. The current free live preview is 150 seconds. The available plans and their included time are shown in the purchase screen, which controls if it differs from a general description here.
AI-generated content can be inaccurate, offensive, or inappropriate for your circumstances. Pronunciation, translation, cultural, and grammar feedback is for practice and may contain mistakes. Review important information independently. Pabo does not provide medical, mental-health, legal, financial, or emergency services. Do not rely on an AI character for urgent help or a personal relationship.
3. Subscriptions, billing, and cancellation
Paid plans are auto-renewing subscriptions sold through the applicable app store. The purchase screen shows the plan, billing period, full price in your local currency, included live time, and any introductory offer before you confirm purchase. The store charges your payment method and handles applicable taxes, billing, and refunds under its rules. Your subscription renews until you cancel it through your store account, subject to store terms and any required notice or consent for a price change. Cancel before the renewal date to avoid the next charge; cancellation normally leaves access in place through the already-paid period unless the store's rules or applicable law say otherwise. Deleting Pabo or a Pabo account does not cancel a store subscription.
The app provides a way to restore eligible purchases and a link to manage subscriptions. You may also manage an Apple subscription at Apple's subscription page. Contact the store for store-billed refunds, or contact support+pabo@markdid.dev if an entitlement is missing. Included conversation time is metered by our server and is limited to the current plan period; unused time does not roll over unless an offer expressly says it does. A free preview, promotional access, and invite rewards are subject to the limits shown in the app and may be limited to one use per eligible person or account. A promotional grant does not itself create a paid auto-renewing subscription unless you separately purchase one.
We may change plan features or prices prospectively. Store-billed price changes follow the store's notice and consent process and applicable law. We will not remove an already-paid benefit during its paid period except as required by law, for security, or for a material violation of these Terms, subject to your legal rights.
4. Your content and our license to operate the service
You retain any rights you have in words, messages, and other material you provide ("Your Content"). You give Pabo a limited, nonexclusive license to transmit, process, store, and display Your Content only as reasonably necessary to operate Pabo, provide requested features, protect the service, and comply with law, as explained in the Privacy Policy. You must have the right to submit Your Content. Do not provide private information about another person without permission. AI output may be similar to output given to others, and we do not promise that you own exclusive rights to it. Your use of AI output remains subject to applicable law.
5. Acceptable use
Use Pabo lawfully and respectfully. Do not use it to harass, exploit, or threaten others; create or seek sexual content involving minors; facilitate violence or illegal activity; infringe intellectual-property or privacy rights; probe or disrupt the service; bypass usage limits or payment controls; automate bulk requests without permission; or submit malware. Do not represent AI-generated material as verified professional advice. We may limit or suspend access when reasonably needed to address abuse, fraud, security threats, legal obligations, or material violations, and we will provide notice where appropriate and feasible.
6. App license and third-party services
The app and its design, software, characters, and branding are owned by Pabo or its licensors. We give you a personal, limited, revocable, nontransferable license to use the app for its intended purpose while these Terms apply. You may not copy, redistribute, reverse engineer, or exploit the app except to the extent applicable law permits. Open-source components remain subject to their own licenses.
If you download Pabo through Apple's App Store, Apple's standard Licensed Application End User License Agreement governs the app license unless we provide a separate custom license through Apple. These Terms govern the Pabo service, including accounts and subscriptions, to the extent consistent with that license and mandatory law. Apple is not the provider of Pabo's learning service. Apple, Google sign-in, Supabase, OpenAI, RevenueCat, and dictionary services may have their own terms for the functions they provide. The Privacy Policy identifies the relevant data flows.
7. Suspension, ending use, and deletion
You may stop using Pabo at any time. You may delete local conversations and learning data using available app controls. To request deletion of a server account, contact support+pabo@markdid.dev. We may suspend or terminate access for the reasons in Section 5, after considering the nature of the issue and applicable law. If access ends, your app license ends, but accrued payment obligations and sections that by their nature survive will continue. Account deletion and subscription cancellation are separate actions.
8. Disclaimers and limits on liability
We work to make Pabo available and useful, but AI and online services may be interrupted or make mistakes. To the maximum extent permitted by law, Pabo is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not promise a particular language outcome, uninterrupted access, or error-free AI output. Nothing here limits a warranty or consumer right that cannot legally be excluded.
To the maximum extent permitted by law, MarkDid, LLC and its personnel will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from Pabo. Our aggregate liability for claims arising from the service is limited to the greater of the amount you paid Pabo through the applicable store during the 12 months before the claim or US$100. This limit does not apply where law prohibits it, or to liability that cannot legally be limited, including our fraud, willful misconduct, or personal injury caused by our negligence where applicable. Some jurisdictions do not allow some of these exclusions, so they may not apply to you.
9. Changes and disputes
We may update these Terms when the service, law, or business changes. We will post an updated effective date and give additional notice for material changes where required. Changes will apply prospectively. If you do not agree to an updated version, stop using the service and cancel any subscription. We may also discontinue features, subject to already-paid entitlements and applicable law.
These Terms are governed by the laws of Utah, United States, excluding conflict-of-laws rules, except where mandatory consumer law in your place of residence requires otherwise. Before filing a claim, you may contact us at support+pabo@markdid.dev so we can try to resolve it informally. Nothing in this section prevents you from using a small-claims court or a regulator where allowed by law.
If one provision is unenforceable, the rest remains effective. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer these Terms as part of a merger or sale, subject to applicable law.
